Dans le présent texte, l'auteur tente de délimiter les différents problèmes liés à l'utilisation de l'échange de documents informatisés pour les lettres de crédit. L'utilisation d'une telle technique permettra une transmission très rapide des documents relatifs au crédit documentaire et leur assurera, à condition de respecter certaines formalités, un caractère authentique. Cependant, le remplacement du mécanisme traditionnel du crédit documentaire par une forme électronique engendre des problèmes liés à la dématérialisation des documents et à la dématérialisation de l'opération même du crédit documentaire. Le Code civil du Québec répond en partie aux conséquences de la dématérialisation des documents, quoique le projet de règles juridiques sur l'utilisation de l'échange de documents informatisés de la Commission des Nations Unies pour le droit commercial international réponde déjà aux principales préoccupations par rapport à la question. Quant à la dématérialisation de l'opération du crédit documentaire, l'émission, l'amendement, la notification et le paiement ne causent pas vraiment de problèmes grâce à l'apport du réseau SWIFT. Mais, en ce qui a trait à la réalisation du crédit documentaire, les règles ne sont pas encore précises.
Abstract
This paper addresses the various problems associated with the use of EDI (Electronic Data Interchange) for letters of credit. The advantages of such technology permit high speed transmission of documents dealing with documentary credit and also guarantee their authenticity, providing compliance with certain formalities. Nonetheless, the transposing of the ordinary means for expediting documentary credits onto an electronic support creates problems owing to the dematerialization of the documents and that of the documentary credit process itself. The Civil Code of Quebec provides a partial answer to the consequences of the dematerialization of documents while the proposed UNCITRAL legal rules governing the use of EDI answer the main concerns raised by this question. As for the dematerialization of the documentary credit process, the issuing, amending, notification and payment do not truly cause any problems thanks to the contribution of the SWIFT network The rules governing the production of the documentary credit, however, remain to be accurately laid down.
