DU DROIT COSMOPOLITIQUE AU DROIT GLOBAL : POUR UNE RUPTURE ÉPISTÉMOLOGIQUE DANS L’APPROCHE JURIDIQUE

Résumé

Le présent article vise à sensibiliser les juristes à une réflexion épistémologique autour des concepts de droit cosmopolitique et de droit global. Ces concepts nous semblent aujourd’hui trop souvent négligés et, dans la perspective de leur redonner leur place, délaissant volontairement l’approche juridique « classique », nous lui préfèrerons une démarche scientifique en trois étapes. Tout d’abord, nous opérerons une rupture nette avec l’illusion juridique qui résulte essentiellement du positivisme juridique et du nationalisme méthodologique. Ensuite, nous présenterons la construction théorique du droit cosmopolitique à travers sa genèse et son actualisation. Enfin, nous constaterons, de manière empirique, que la notion émergente de droit administratif global présente un profond lien de filiation avec celle de droit cosmopolitique.

Abstract

The following article aims to raise awareness among jurists through an epistemological reflection on the concepts of Cosmopolitan law and Global law. Both appear to us somehow neglected today. In a perspective of rehabilitation, we voluntarily leave aside the classic legal approach to instead choose a scientific approach in three steps. First, we will radically break with the legal illusion that is essentially based on methodological nationalism and legal positivism. Second, we shall present the theoretical construction of Cosmopolitan law through its genesis and updating. Thirdly, we will figure, in an empirical way, that the emerging notion of “Global administrative law” is dramatically linked to Cosmopolitan right.
