LE RETRAIT DU CANADA DU PROTOCOLE DE KYOTO ET LE DROIT INTERNATIONAL PUBLIC – DROIT DE DÉNONCIATION, ABUS DE DROIT ET RESPONSABILITÉ INTERNATIONALE

Résumé

Le 15 décembre 2011, le Canada surprenait en dénonçant le Protocole de Kyoto. Le retrait du Canada du Protocole de Kyoto s’est fait légalement : non seulement le Protocole en prévoyait la possibilité mais la manière dont le Canada s’est comporté ne mène pas à conclure qu’il y a eu abus de droit. Le Canada n’est donc plus lié par ses obligations depuis le 15 décembre 2012. Il n’en demeure pas moins que la dénonciation ne produisant d’effets que pour l’avenir, le Canada ne peut se servir de son retrait comme échappatoire technique l’autorisant à justifier ou à faire oublier son inaction des dernières années. Au contraire, son retrait attire l’attention sur son inaction qui se traduit en une violation d’une obligation de résultat, constitutive d’un fait internationalement illicite. Pour cette raison, l’ensemble des États parties au Protocole peut invoquer la responsabilité internationale du Canada. C’est à un contrôle de la légalité internationale que la théorie de la responsabilité internationale pourra ainsi servir.

Abstract

On December 15th, 2011, Canada caught everyone by surprise by denouncing the Kyoto Protocol. The withdrawal of Canada from the Kyoto Protocol was conducted legally: the Protocol not only laid the grounds for it, but the way Canada behaved does not lead to the conclusion that there was right abuse. Therefore, Canada is no longer bound by its obligations since December 15^th, 2012. However, it remains true that denunciation produces its effects only in the future and Canada cannot use its withdrawal as technical alibi to justify or overshadow its inaction over the last years. On the contrary, its withdrawal points to its inaction which constitutes a violation of the obligation of result, constituting an internationally wrongful conduct. For this reason, most of the states that are part of the Protocol, can denounce Canada international responsibility. The theory of the international responsibility will serve best through the application of the international legality.
