LA RESPONSABILITE CIVILE DU MEDECIN ANESTHESISTE (1ère partie)

Résumé

L’anesthésie moderne a vu le jour voici plus d’un siècle et s’est imposée progressivement comme spécialité médicale à part entière. Privant le patient de ses moyens de défense pour permettre la réalisation de l’intervention chirurgicale, elle constitue un domaine à risque élevé. L’étude porte sur l’application, à l’anesthésie-réanimation, des principes traditionnels de la responsabilité civile, en droit québécois et en droit privé français. La notion de faute est analysée à travers la jurisprudence pertinente, aux différentes étapes préopératoire, opératoire et postopératoire. Si elle s’inscrit généralement dans le cadre de l’obligation médicale de moyens, la possibilité d’obligation de résultat, dans certaines circonstances restreintes, est néanmoins soulevée. La complexité des relations juridiques entre le patient et les membres de l’équipe chirurgicale permet une réflexion sur les approches différentes du droit québécois et du droit français en la matière. Travaillant souvent avec des auxiliaires, l’anesthésiste peut-il être tenu responsable de leurs actes fautifs ? Le critère de surveillance immédiate mis de l’avant par les auteurs pour justifier un lien de préposition occasionnel est mis en doute. L’auteur rappelle enfin que la sécurité du patient doit motiver toutes les décisions prises en anesthésie.

Abstract

Modern anaesthesia originated more than a century ago, and has evolved into a distinct medical specialty. Lowering the patient's consciousness of pain in order to permit him to undergo surgery, it constitues a high risk activity. This study deals with the application to anaesthesia of those traditionnal civil liability principles applicable in Quebec and French private law. The concept of fault is analized through a study of relevant judicial decisions involving the preoperative, operative and postoperative stages of anaesthesia. Even if the duty to treat is usually analized as an obligation of means, the possible existence of some restrictive obligations of result is raised. The complexity of the juridical relationships between patients and members of the surgical team enables one to compare the different approches proposed in Quebec and in French law. Because anaesthetists are frequently called upon to work with auxiliairies, his or her potential liability for the wrongful acts of said auxiliaries is examined. This writer doubts that an occasionnal master-servant relationship is created by the "immediate supervision" criterion. Finally, one must not forget that the patient's safety is the primary consideration in every decision relation to anaesthesia.
