Justice Malcolm Rowe is a judge of the Supreme Court of Canada. He previously served as Secretary to the Cabinet and head of the public service in Newfoundland and Labrador. He has also served as a member of Canada’s diplomatic service and was a partner at Gowlings. He was appointed to the Supreme Court of Newfoundland and Labrador in 1999, to the Court of Appeal in 2001, and to the Supreme Court of Canada in 2016. Diane Shnier served as a law clerk to Justice Rowe at the Supreme Court of Canada in 2020-2021, during which time they co-authored this article. Diane is now an associate at Polley Faith LLP.
