Given the asymmetrical nature of international relations in the western hemisphere throughout the history of the OAS, we postulate that the dynamic of those relations explains major developments within the Inter-American human rights system, whereas the reverse is not the case. In other words, the system, its norms and constraints, have influenced little the direction of relations amongst states in the Americas. An historical overview reveals however that the system has consistently shown itself able to exploit “windows of opportunity” to push back the frontiers of its institutional limits, but this ability to impose more stringent human rights norms is never entirely unquestioned and remains highly contested by the member states. The article uses a periodisation of relations in the hemisphere on the one hand, and those within the inter-American system, on the other. It then analyses the periods that show strong correlation between international relations and innovations within the system in order to identify trends and perspectives for the future. It concludes with three possible scenarios for the immediate future of the system, based on emerging trends in international relations.

Étant donné l’asymétrie des relations internationales à l’ouest durant la période d’existence de l’OAS, nous postulons que la dynamique de ces relations permet d’expliquer des développements majeurs au sein du système inter-américain des droits humains, alors qu’il en est tout autrement dans le cas inverse. En d’autres termes, le système, ses normes, et ses contraintes ont peu influencé la voie des relations inter-étatiques dans les Amériques. Un aperçu historique révèle cependant que le système s’est constamment montré capable de tirer profit « des fenêtres d’opportunité » pour repousser les frontières de ses limites institutionnelles, mais cette capacité à imposer des règles plus strictes de respect des droits humains n’est jamais entièrement acceptée, et demeure largement contestée par les États membres. L’article utilise une double périodisation des relations dans l’hémisphère et des relations au sein du système inter-américain. Il analyse ensuite les périodes qui révèlent un lien fort entre les relations internationales et les innovations au sein du système dans le but d’identifier les tendances et les perspectives d’avenir. Il se conclue par une description de trois scénarios possibles concernant le futur immédiat du système, fondés sur les tendances émergeantes en relations internationales.

THE ROLE OF INTERNATIONAL REGIMES IN THE CONSTITUTION OF STATE BEHAVIOR AND IDENTITY: THE CASE OF CONTEMPORARY MEXICO

This article explores the role played by international human rights regimes in the transnational and domestic politics of human rights of Mexico. Following international relations constructivists and liberal republican approaches, this article argues that international human rights regimes have played a key role in Mexico in the following ways: a) they have provided the normative standards, information about behavior, and necessary forums for processes of shaming and argumentation; b) regimes’ organs, bodies and mechanisms have been important actors in their own right in the aforementioned processes; c) regimes have been instrumental in the strategies of government elites seeking to secure their preferences in domestic politics. This article ends by offering a framework that might prove useful for understanding the role of international human rights regimes in other country-specific situations and by reflecting on the theoretical implications of its main argument.

Cet article examine le rôle que jouent les régimes internationaux des droits humains dans la politique nationale et transnationale des droits de la personne au Mexique. Suite aux constructivistes en relations internationales et aux approches libérales républicaines, nous estimons que les régimes internationaux de protection des droits humains ont joué un rôle particulièrement important au Mexique, car : a) ils ont fourni des standards, des forums adéquats et des moyens de pression efficaces pour contraindre les institutions mexicaines à respecter les droits humains; b) les organes et mécanismes de ces régimes de protection ont été des acteurs importants de promotion des droits humains; c) ces régimes ont contribué à l’élaboration de stratégies de mise en valeur des droits humains par les élites gouvernementales au plan national. Nous terminerons en offrant un cadre d’analyse pour comprendre le rôle que les régimes internationaux de protection des droits humains peuvent jouer dans d’autres situations nationales.

THE INTER-AMERICAN COURT OF HUMAN RIGHTS: THE AMBASSADOR OF UNIVERSALISM

The Inter-American Court of Human Rights has developed an original, creative, avant-garde and even “legally non-conformist” jurisprudence. The Court takes certain liberties with regard to the way in which it interprets the American Convention, treating the State-centric paradigm and voluntarism with disdain and consequently risks displeasing member States and internationalist scholars. However, the Court adopts this attitude intentionally and asserts the Inter-American distinctiveness through its own construction of legal universalism. In order to analyse it, the paper will describe the Court's work through the prism of a number of problems, emphasizing the most salient characteristics of this “Inter-American doctrine”: individualization; criminilization; constitutionalization; humanization; and moralization of inter-American law.

La Cour interaméricaine des droits de l’homme a développé une jurisprudence originale, créative, d’avant-garde et même « juridiquement non-conformiste ». La Cour prend certaines libertés dans son interprétation de la Convention américaine, en rupture avec le paradigme Stato-centré et le volontarisme étatique, au risque de déplaire aux États parties et aux internationalistes. Toutefois, la Cour adopte cette posture de manière intentionnelle et affirme le particularisme interaméricain des droits de l’homme grâce à sa construction d’un universalisme juridique. Ce particularisme est identifiable à travers la jurisprudence de la Cour. Cet article analyse, identifie et évalue les traits saillants de ce particularisme interaméricain et tente d’en mesurer la portée : individualisation; criminalisation; constitutionnalisation; humanisation; et moralisation du droit interaméricain.

THE EXTERNAL RECEPTION OF INTER-AMERICAN HUMAN RIGHTS LAW

This article examines the ways in which Inter-American human rights law has been received and employed outside its own sphere. The Inter-American Court and Commission engage self-consciously in dialogue and borrowing from the global human rights system and the other regional human rights tribunals. Tracing the reciprocal influence of Inter-American developments is a complicated undertaking, because official texts may either understate or overstate the degree to which their authors have relied upon external sources. Examination of the jurisprudence of other human rights tribunals produces mixed results that require interpretation. The African and European regional tribunals have openly engaged with Inter-American precedents on procedure and substance from both the Court and the Commission, although less extensively than the Inter-American Court’s methodology leads it to draw from Europe. The International Court of Justice and the UN Human Rights Committee have generally avoided open reference to regional precedent in their institutional opinions, while arguably some tacit influences can be traced. Some express discussion of Inter-American precedent does occasionally appear in concurring or dissenting opinions. The Inter-American Court has had less success, however, in exporting its views on jus cogens.

La Cour et la Commission interaméricaines s’engagent consciemment dans un dialogue avec le système universel des droits de l’homme ainsi qu’avec d’autres tribunaux régionaux de protection des droits de l’homme. Retracer l’influence réciproque des développements interaméricains est une tâche compliquée, car les textes officiels peuvent soit minimiser soit exagérer le degré d’appui de leurs auteurs sur des sources externes. L’étude de la jurisprudence des autres tribunaux des droits de l’homme produit des résultats mitigés et requiert un effort d’interprétation. Les tribunaux régionaux africains et européens se sont ouvertement référés aux précédents de la Cour et de la Commission interaméricaines, tant sur le fond que sur la forme, bien qu’à une fréquence moins importante que celle avec laquelle la Cour interaméricaine s’inspire des précédents européens. La Cour internationale de justice et le Comité des droits de l’homme de l’ONU ont en général évité d’évoquer le précédent régional dans leurs opinions institutionnelles, même si l’on dénote certaines influences. Le thème du précédent interaméricain survient de temps à autre parmi les opinions divergentes ou concordantes. Par contre, la Cour interaméricaine a connu moins de succès lorsqu’il s’agissait d’exporter ses opinions sur le jus cogens.

THE INTER-AMERICAN HUMAN RIGHTS SYSTEM FIFTY YEARS LATER: TIME FOR CHANGES

This article analyzes the latest reforms of rules and regulations of the Inter-American Commission on Human Rights (IACHR) and the Inter-American Court of Human Rights and the overall functioning of the Inter-American human rights system. Particularly the article focuses on the strengths and weaknesses of the judicialization of the Inter-American amparo. The paper identifies the measures necessary to allow the Inter-American system to play a more prominent role in the promotion and protection of human rights. Specific measures include mainstreaming the work of the OAS around human rights issues, including in the Inter-American Democratic Charter a stronger link between democracy and the protection of human rights, and balancing the work on individual complaints with other tools available to the IACHR. It proposes a fundamental change in the IACHR’s profile through the modification of its participation in the individual petition system. The Commission should only act as an organ of admissibility and facilitator of friendly solutions, and the Court as a tribunal that carries out findings of fact and makes legal determinations on the merits of complaints. The IACHR needs to concentrate more heavily on political and promotional activities that complement its limited participation in the processing of individual cases.

Cet article examine les dernières réformes des lois et réglementations de la Commission Interaméricaine des Droits de l’Homme (CIDH) et de la Cour interaméricaine des droits de l’homme, ainsi que le fonctionnement général du système des droits de l’homme interaméricain. Plus particulièrement, cet article s’intéresse aux atouts et aux inconvénients de la « judiciarisation » de l’amparo interaméricain. Ce document introduit les mesures nécessaires afin de promouvoir le rôle décisif du système interaméricain en matière de protection des droits de l’homme. Parmi ces mesures, certaines consistent à recentrer le travail de l’OEA autour de questions de droits de l’homme, à instaurer dans la Charte interaméricaine des droits de l’homme un lien plus substantiel entre la démocratie et la protection des droits de l’homme, et à compenser le travail portant sur les plaintes individuelles par d’autres outils dont dispose la CIDH. Ces propositions visent à modifier fondamentalement le mode de participation de la CIDH au système de pétition individuel. La Commission ne devrait agir qu’en tant qu’organe de recevabilité et dans le but de faciliter les solutions à l’amiable, tandis que la Cour ne devrait agir qu’en tant que tribunal, poursuivant la découverte de faits nouveaux et jugeant du mérite légal des plaintes. La CIDH doit se concentrer de manière plus appuyée sur les activités politiques et promotionnelles qui contrebalancent sa participation restreinte au traitement de dossiers individuels.

CIVIL SOCIETY INTERACTIONS WITHIN THE INTER-AMERICAN INSTITUTIONAL FRAMEWORK: TWO CASE STUDIES IN PROMOTING THE STRENGTHENING OF THE REGIONAL HUMAN RIGHTS SYSTEM

This paper is an attempt to partly address the question of the impact, on the inter-American human rights system, of non-state actors interacting within the institutional structure of the Organizations of American States (OAS). It reflects the perspective of Rights & Democracy, a Canadian institution with an international mandate to promote democracy by supporting the full realization of all human rights. Rights & Democracy has supported civil society human rights organizations in their battle for a stronger regional human rights system, and a more participatory OAS. The paper first reviews the formal inter-American structure for civil society participation, then submits what is meant to be an empirical contribution. It describes two concrete civil society participation experiences aiming to strengthen the enforcement of inter-American human rights norms: the ongoing process carried out by the International Coalition of Organizations for Human Rights in the Americas, and the actions undertaken by indigenous peoples within the framework of the negotiations surrounding the Draft American Declaration on the Rights of Indigenous Peoples. The paper ends with some concluding remarks on a mitigated assessment of civil society participatory mechanisms within the OAS.

Cet article s’inscrit dans le cadre d’une exploration des impacts, sur le système interaméricain de protection des droits humains, des interactions entre les acteurs non étatiques et la structure institutionnelle de l’Organisation des États américains (OÉA). Il se veut le reflet de l’approche adoptée par Droits et Démocratie, une organisation canadienne dont le mandat est de promouvoir la démocratie dans le monde via le renforcement de la pleine réalisation des droits humains, dans le cadre de son appui aux efforts des organisations de la société civile des Amériques pour assurer l’efficacité du système régional de protection des droits, d’une part, et des mécanismes de participation de l’OÉA, d’autre part. Dans un premier temps, les structures formelles de l’OÉA relatives à la participation de la société civile y sont examinées. Puis, sont présentées des observations d’ordre empirique portant sur deux initiatives concrètes de participation spécifiquement destinées à favoriser la pleine application des normes interaméricaines de droits humains : le processus conduit par la Coalition internationale des organisations pour les droits humains dans les Amériques, et les efforts entrepris par les peuples autochtones dans le cadre des négociations entourant le Projet de Déclaration américaine sur les droits des peuples autochtones. L’article se conclut sur quelques remarques finales concernant les forces et limites des mécanismes actuels de l’OÉA en matière de participation de la société civile.
