LA QUESTION DU CARACTÈRE OBLIGATOIRE DES MESURES CONSERVATOIRES DEVANT LA COUR INTERNATIONALE DE JUSTICE L’ARRÊT La Grand (Allemagne c. États-Unis d’Amérique) DU 27 JUIN 2001

Résumé

Soupçonnés d’avoir participé à une tentative de vol à main armée dans une banque et d’avoir tué son directeur, Karl et Walter La Grand, ressortissants allemands, ont été arrêtés par la police américaine avant d’être traduits en justice. Les frères La Grand ont toutefois été jugés et condamnés à mort sans être informés de leur droit de bénéficier de l’assistance consulaire. Les autorités allemandes ont vainement essayé certaines démarches diplomatiques et consulaires, avant de s’adresser aux juridictions américaines qui ont refusé d’ordonner un sursis à l’exécution. N’ayant pu sauver Karl La Grand, qui fut exécuté en 1999, l’Allemagne s’est dirigée vers la Cour internationale de justice, pour demander, à titre conservatoire, la suspension de l’exécution de Walter La Grand. C’est principalement le caractère obligatoire des mesures conservatoires indiquées par la Cour dans cette affaire qui fait l’objet de la présente étude. La confirmation du caractère obligatoire des mesures conservatoires dans la présente affaire est l’aboutissement d’un lent processus allant de la simple négation de tout effet juridique à une reconnaissance implicite et timide pour arriver enfin à cette affirmation tranchante qui a caractérisé les considérants de l’arrêt du 27 juin. En effet, la confirmation du caractère obligatoire des mesures conservatoires, outre le fait qu’elle permet à la Cour de s’acquitter pleinement de ses fonctions judiciaires et de contribuer au maintien de la paix et de la sécurité internationales ouvre devant les requérants la possibilité de s’en prévaloir devant le Conseil de sécurité pour en assurer l’exécution. En outre, l’auteur conclut en suggérant que l’organe judiciaire principal des Nations Unies peut aussi inspirer d’autres organes chargés de contrôler le respect des droits de la personne, pour dépasser la mutité des textes conventionnels, renier un formalisme juridique et assurer une protection effective de la personne humaine.

Abstract

Suspected of having taken part in an attempted armed robbery in a bank and of having killed its director, Karl and Walter La Grand, two German nationals, were arrested by an American local police force. However, the La Grand brothers were judged and condemned to death without having been informed of their right to consular assistance. The German authorities tried various diplomatic and consular channels without success, before seizing the appropriate American jurisdictions, which refused to defer the execution. Unable to save Karl La Grand, which was put to death in 1999, Germany went to the International Court of Justice, to ask, on a purely conservatory basis, the suspension of Walter La Grand's execution. The present study focuses mainly on the mandatory character of the conservatory measure ordered by the Court. The confirmation of the mandatory character of conservatory measures in the La Grand case is the latest development of a slow process that first denies any legal effect, then finds an implicit and timid recognition, and finally arrives at this sharp assertion that characterizes the ICJ's decision. Indeed, the confirmation of the obligatory character of conservatory measures, in addition to the fact it will allow the Court to fulfill its legal functions more efficiently and that it will contribute to the maintenance of international peace and safety, will open the possibility for claiming states to petition the Security Council to ensure their execution. Moreover, the author concludes by suggesting that the United Nations' main legal organ can also inspire other bodies charged to control the respect of human rights to exceed the muteness of international conventions, to disavow legal formalism and to ensure an effective protection of the human person.
