Résumé

La participation et la mise en application des conventions et engagements du Sommet Planète-Terre de Rio par le Québec dépendaient du rapport de force constitutionnel fédéral-provincial. Pour s’assurer d’une participation au processus, le Québec et les autres provinces invoquaient leurs compétences en matières internationales et dans le domaine de l’environnement. Le Québec cherchait, de cette façon, à s’assurer un rôle dans l’élaboration et la mise en application des accords de Rio. Une collaboration fédérale-provinciale était nécessaire étant donné le partage des pouvoirs et le principe d’un fédéralisme équilibré sous-tendus dans la Constitution canadienne. Les auteurs examinent si cet équilibre du fédéralisme a été respecté dans le cadre du Sommet Planète-Terre de Rio.

Abstract

The participation and the implementation of the conventions and agreements of the Earth Summit by the province of Québec depended on the contention for power between the federal and provincial governments. In order to ensure their participation in this process, Québec and the other provinces relied on their powers in matters of the environment and of international relations. In doing so, the province of Québec hoped to guarantee itself of a role in the elaboration and implementation processes of the Rio agreements. Cooperation between the federal and provincial levels was necessary given the division of powers and the principle of balanced federalism that is latent to the Canadian Constitution. The authors examine the respect of this balanced federalism throughout the Earth Summit negociations.
