Le patrimoine familial : une qualification difficile

Résumé

L’auteur met en évidence la motivation politique et les difficultés techniques de la loi établissant le patrimoine familial. Cette institution, un intrus dans le Code civil, est étudiée dans sa perspective historique et dans son contexte : les régimes matrimoniaux dans un Code civil. L’article propose une interprétation et une qualification civilistes du patrimoine familial.

Abstract

The author underlines the political motivation and the technical difficulties of the law establishing the Family Patrimony. This institution, an intruder in the Civil Code, is studied under its historical perspective and in its proper context: matrimonial regimes in a Civil Code. The paper proposes a civilist interpretation and characterisation of the Family Patrimony.
