La présence sur les lieux du crime

Résumé

Peut-on engager sa responsabilité criminelle suite à sa présence physique dans un endroit particulier ? Le présent texte répond à cette question en analysant les éléments essentiels à la commission réelle d’une infraction ou à la participation secondaire à une infraction commise par une autre personne.

Le but de cet article consiste à démontrer que la présence en soi n’équivaut jamais à l’élément matériel des crimes prévus au Code criminel. Par contre, on y étudie aussi les conditions permettant de conclure que la présence dans un lieu peut correspondre aux modes de participation criminelle définis aux articles 21(1)b) ou 21(1)c) C.cr.

Abstract

Can people be found guilty of a criminal offence simply by being present in a certain place? The following text answers this question by analyzing the essential elements of either committing an offence or participating in an offence committed by another person.

This article will show that simple presence by itself does not constitute the material element of a crime as given in the Criminal Code. Further analysis, however, demonstrates that physical presence in a location could correspond to criminal participation as stated in paragraphs 21(1)b) or 21(1)c) of the Criminal Code.
