Résumé

Notre pratique professionnelle en tant que psychologue en milieu carcéral interroge régulièrement l’articulation entre la fonction soignante et les contraintes de l’application de la peine, compte tenu des interactions inévitables, ne serait-ce que du fait du contexte environnemental. Ainsi, nous avons souvent été interpellés par l’attitude de certains détenus qui paraissaient plus difficilement mobilisables par rapport au soin après leur jugement.

Cette étude exploratoire a pour objectif, à la fois d’évaluer les effets temporels ainsi que les effets du type de passage à l’acte sur l’ouverture au soin. Ainsi, au travers d’indicateurs au soin préalablement définis, nous avons réalisé une étude comparative de 20 sujets en procédure criminelle dans l’idée d’évaluer l’ouverture au soin au temps avant jugement et au temps après jugement avec l’hypothèse que le temps de l’avant jugement pouvait constituer un moment privilégié.

Au regard de l’ampleur de la littérature consacrée au soin pour les auteurs de violence à caractère sexuel et des dispositions légales relatives au suivi socio-judiciaire avec injonction de soin, tout à fait innovantes en France (loi du 17 juin 1998), nous avons été amenés à différencier les auteurs de violence à caractère sexuel, des auteurs de crimes de sang.

Les résultats nous amènent à penser que les sujets de notre étude présentent une ouverture au soin plus marquée au temps avant jugement et qu’ils sont plus difficilement mobilisables après leur jugement. Cette différence se trouve d’autant plus marquée chez les auteurs de violence à caractère sexuel. Ce qui interroge le sens et les enjeux de cette ouverture au soin.

Abstract

As a professional prison psychologist, we are frequently led to ponder about the interaction between our therapeutic duty and the demands of the prison sentence, starting with the unavoidable constraints which result from the environmental context of prison life. We have often been struck by the attitude of some inmates who seemed more reluctant to engage in therapy once their trial had occurred.

The following essay therefore deals with how differently prisoners accept to engage in therapy depending on the length of their jail sentence, and suggests that we should consider therapy according to the patient’s dynamic psyche in connexion with his / her situation in the unfolding of his / her sentence.

This study trie to appraise if the moment to attend and the kind of crime influence the pledging for therapy. Thus, relying on pre-defined markers, we have completed a comparative study of twenty inmates undergoing criminal procedure. The study aimed at assessing how inmates accept to engage in therapy before and after their trial, hypothesizing that the time before trial might prove a priviledged period. In addition, the numerous articles dealing with the therapy of sexual offenders on the one hand, and the implementation of therapy injunction introduced by the highly innovating law in FRANCE of June 17^th 1998 on the other hand, have led us to our study by differentiating them from psychopath criminals, so as to identify what distinguishes them regarding their attitude to therapy. Our study shows that the subjects are more engage in therapy before judgment and its difficult to mobilize them after judgment. This difference is accrued for the sex offenders. When analyzing the data we gathered, we have also attempted to define the limits and the stakes of such acceptance of therapy.

Resumen

Nuestra practica profesional de psicólogo en entorno carceral destaca la problemática de la articulación entre la función del cuidado y las obligaciones de aplicación de las sanciones, tomando en cuenta las interacciones inevitables, como por ejemplo el contexto del entorno.

Nos hemos frecuentemente percatado de que algunos detenidos parecían más dificilmente mobilizables para el cuidado después del juicio.

El objectivo de este estudio exploratorio es de evaluar a la vez los efectos temporales y los efectos del pasar a los hechos en cuanto a la disposicion al cuidado.

Así, a través de indicadores del cuidado prealablemente definidos, hemos realizado un estudio comparativo de veinte pacientes en procedimiento criminal, con la idea de evaluar la apertura al cuidado según el tiempo antes del juicio y después del juicio, con la hipótesis de que el tiempo antes de juicio podría ser el más privilegiado. Considerando la cantidad de literatura consagrada al cuidado de autores de violencia de carácter sexual y las disposiciones legales de obligaciones al cuidado relativas a la ley del 17 de junio del 1998, verdaderamente novadoras, totalmente novadoras en Francia, hemos llagado a diferenciar a las autores de violencias de caracter sexual de los autores de crimenes de sangre.

Los resultados nos sugieren que los sujetos de nuestro estudio presentan una disposicion al cuidado mas pronunciada al tiempo antes del juicio y que son mas dificilmente movilizables despues del juicio. Esta diferencia se nota mayormente con los autores de violencias sexuales. Esto interroga el sentido y lo que esta en juego con el acceso al cuidado.
