« Bonne foi » et insertion par le logement. L’individualisation des politiques sociales et la prévention des expulsions locatives “Good Faith” and Social Integration Through Housing: Individualization of Social Policies and Prevention of Tenant Evictions

L’article porte sur la notion de « bonne foi » dans les politiques françaises de prévention des expulsions locatives. Dans l’évaluation des commissions attribuant des aides aux locataires en difficulté, nous distinguons trois figures de l’individu défaillant comme « coupable-responsable », « victime » ou « incapable ». Pour les situations indécises, l’invocation de la bonne foi permet de départager les demandeurs entre coupables-responsables et victimes. Les critères de la bonne foi sont flous et ces jugements restent incertains. Parmi les critères avancés, l’impossibilité de contacter les locataires ou la récidive renseignent sur les attentes de ces politiques sociales envers leurs bénéficiaires.

Abstract

The concept of “good faith” in French policies on the prevention of tenant evictions is discussed in this paper. An examination of the boards that allocate aid to tenants in trouble finds that they distinguish three types of defaulting individual: “guilty-responsible,” “victim” and “incapable.” In unclear situations, calling on good faith can help sort applicants into two categories: guilty-responsible and victims. Good-faith criteria are fuzzy, and these judgments remain vague. Among the criteria put forward, the impossibility of contacting tenants and recidivism provide indications regarding the expectations that these social policies place on their beneficiaries.
