Sovereignty between Effectiveness and Legitimacy: Dimensions and Actual Relevance of Sovereignty in Bodin, Hobbes and Rousseau

According to a widespread understanding, the idea and the reality of state-sovereignty are in crisis, and may even have come to an end. The state is becoming a “cooperative” state which is no longer capable of imposing its will, and is thus but one social actor among others. This diagnosis relies on a concept of sovereignty which is basically defined by the capacity of the state to organize and rule society. The present article inquires into the conceptual basis of this kind of description, analysis and critique. Are we dealing with an appropriate analysis of current developments? Are the dimensions of state sovereignty, associated in historical and systematic perspective, adequately described? In order to answer these questions the article goes back to the foundations of modern sovereignty, its practical dimensions and its concomitant problems as outlined in Bodin, Hobbes and Rousseau.

Selon une idée largement répandue, l’idée et la réalité de l’État souverain sont aujourd’hui en crise et seraient même sur le point de connaître leur fin. L’État se fait „coopératif“ parce qu’il se voit incapable d’imposer sa volonté. Il se révèle seulement un acteur social parmi d’autres. Ces diagnostics se basent sur une conception de la souveraineté définie principalement par la capacité de l’État à organiser et à diriger la société. Le présent article s’interroge sur les bases conceptuelles sur lesquelles s’appuient ces formes de description, d’analyse et de critique. S’agit-il ici d’une conceptualisation appropriée pour penser l’évolution contemporaine ? Est-ce que les dimensions liées de façon historique et systématique au concept de souveraineté de l’État, sont décrites de manière adéquate ? Dans le but de répondre à ces questions, l’article revient sur la dimension pratique et les problèmes inhérents au concept moderne de la souveraineté, en relation avec la façon dont elle a d’abord été élaborée par Bodin, Hobbes et Rousseau.

Nach einer weithin verbreiteten Auffassung durchlaufen der Begriff wie die Realität des souveränen Staates gegenwärtig eine Krise, sind vielleicht sogar an ihr Ende gelangt. Der Staat wandle sich zum „kooperativen“ Staat, der nicht mehr in der Lage sei, seinen Willen einseitig durchzusetzen, vielmehr zu einem sozialen Akteur unter anderen geworden sei. Diese Diagnosen stützen sich auf einen Begriff von Souveränität, der im Wesentlichen durch die Fähigkeit des Staates definiert ist, die Gesellschaft zu organisieren und zu lenken. Der vorliegende Artikel untersucht die konzeptuellen Grundlagen dieser Art von Beschreibung, Analyse und Kritik. Handelt es sich dabei um eine zutreffende Analyse der gegenwärtigen Entwicklungen? Sind die der Souveränität des Staates in historischer wie systematischer Perspektive zugeschriebenen Dimensionen in angemessener Weise erfasst? Zur Beantwortung dieser Fragen geht der Artikel zurück auf die Grundlagen der Souveränität, die praktische Dimension des modernen Konzepts der Souveränität und die damit verbundenen Probleme, so wie sie bei Bodin, Hobbes und Rousseau reflektiert wurden.

Après la souveraineté : que reste-t-il des droits subjectifs ?

La notion de droits subjectifs est une notion moderne. Sa consistance a été contestée par différents auteurs (Michel Villey, Vincent Descombes). L’idée que l’individu pourrait faire valoir des droits en vertu de sa qualité d’homme est un des aspects de l’individualisme des Temps modernes. En empruntant (et détournant) une hypothèse de Michel Foucault, relative aux rapports entre individualisation et pouvoir, et en sollicitant certaines analyses de Max Weber dans sa Sociologie du Droit, on propose de comprendre l’émergence de l’individu porteur de droits en relation avec la formation de l’Etat souverain moderne, sur le fond de l’éradication des « droits privilèges » des sociétés statutaires. L’érosion de la souveraineté étatique, sous l’effet notamment du développement, à l’échelle mondiale, d’un pluralisme juridique qui semble résister à toute réorganisation hiérarchique, invite à s’interroger sur le devenir de cette figure du sujet juridique dans la socialisation politique en gestation. C’est l’avenir de la démocratie qui est ici en jeu, pour autant que, en sa forme moderne, elle présuppose que les individus doivent se voir reconnaître et garantir des droits indépendamment de leurs appartenances communautaires particulières.

The notion of subjective rights is a modern concept. Its consistency has been put into question by a series of authors (Michel Villey, Vincent Descombes). The idea that an individual in his or her role as a human being can appeal to rights is an aspect of modern individualism. By starting from (and inverting) an hypothesis of Michel Foucault concerning the relationship between individualization and power and by referring to various aspects of Max Weber’s Sociology of Law, the present article proposes to see the emergence of the juridical individual in relationship with the emergence of the modern sovereign state, i.e. with the abolition of the privileges of the estatist society. The erosion of state sovereignty, especially as a result of the development of juridical pluralism on the international level, a pluralism which seems to resist to all attempts at hierarchical reorganization, raises the question of the future of this form of a juridical subject in the framework of the present political evolution. The future of democracy is at stake here, to the extent that in its modern form for individuals it is essential to rely on their rights being recognized and guaranteed independent of social status and belonging.

Der Begriff subjektiver Rechte ist ein moderner Begriff. Seine Konsistenz ist von einer Reihe von Autoren bezweifelt worden (Michel Villey, Vincent Descombes). Die Idee, dass das Individuum in seiner Rolle als Mensch sich auf Rechte berufen könne, ist ein Aspekt des modernen Individualismus. Unter Aufnahme (und Umkehrung) einer Hypothese Michel Foucaults bezüglich des Zusammenhangs von Individualisierung und Macht sowie unter Heranziehung von verschiedenen Analysen aus Max Webers Rechtssoziologie wird in vorliegendem Artikel vorgeschlagen, die Entstehung des Rechtsindividuums im Zusammenhang mit der Entstehung des souveränen modernen Staats zu sehen, also vor dem Hintergrund der Abschaffung ständestaatlicher Privilegien. Die Erosion staatlicher Souveränität, insbesondere unter dem Eindruck der im internationalen Maßstab stattfindenden Entwicklung eines Rechtspluralismus, der jeder hierarchischen Reorganisation zu widerstehen scheint, fordert zu einer Beschäftigung mit der Zukunft dieser Gestalt des Rechtssubjekts im Rahmen der derzeit stattfindenden politischen Entwicklung auf. Die Zukunft der Demokratie steht dabei auf dem Spiel, und zwar in dem Maße, in dem innerhalb ihrer modernen Ausprägung die Individuen sich müssen darauf verlassen können, dass Rechte unabhängig besonderer sozialer Gruppenzugehörigkeiten anerkannt und garantiert werden.

Sovereigns in the Marketplace: Consumer Groups and Citizenship (without Nations?) in the European Union

The enlargement of Europe and globalization are reconfiguring European consumerism. In this new context, personal, local and national agency in the social and the political relations of consumption are in great flux. I will use some recent language and circulars regarding GMOs to suggest that what consumers may be gaining in active agency through the creation of supranational agencies and NGOs and the proliferation of Internet activism, they may be losing in the accountability of their local governments. Further, the means by which “European” consumers are being created, possibly a classe objet in Bourdieu’s terms, reflects an erosion of national sovereignty and its crisis, producing what may be a “consolation narrative” to the spectre of the failure of democracy.

L’élargissement de l’Europe et la mondialisation modifient profondément le consumérisme européen. Dans ce contexte nouveau, les conditions subjectives, locales et nationales pour défendre les consommateurs au niveau social et politique connaissent des mutations importantes. Je vais recourir à certains discours et publications sur les organismes génétiquement modifiés pour suggérer que ce que les consommateurs gagnent en termes d’influence, d’une part, à travers la création d’agences internationales, d’ONG et par l’important militantisme sur Internet, ils le perdent peut-être, d’autre part, dans le sens d’une diminution de possibilités pour responsabiliser leurs gouvernements locaux. Plus encore, les moyens grâce auxquels on crée des consommateurs « européens » - probablement une « classe objet », pour le dire dans les termes de Pierre Bourdieu - ne témoignent pas seulement d’une érosion de la souveraineté nationale et de sa crise, mais produisent peut-être en même temps une espèce de « récit de la consolation » au regard de l’échec de la démocratie.

Die Ost-Erweiterung Europas und die Globalisierung sorgen auch für einen Wandel des europäischen Verbrauchermarkts. In diesem neuen Kontext sind die individuellen, lokalen und nationalen Bedingungen für die Einwirkung auf die sozialen und politischen Aspekte des Verbrauchermarkts starken Veränderungen unterworfen. In dem vorliegenden Artikel werden einige Beispiele jüngerer Verlautbarungen zu gentechnologisch veränderten Organismen angeführt um zu zeigen, dass dasjenige, was Konsumenten an Handlungsmöglichkeiten auf der Ebene supranationaler Organisationen und NGOs sowie im Sinn der Verbreitung von Internet-Aktivismus gewinnen, möglicherweise auch wieder verloren geht auf der Ebene der Einklagbarkeit von Rechten gegenüber ihren nationalen Regierungen. Darüber spiegeln die Mittel, durch die „europäische“ Konsumenten geschaffen werden, nicht nur eine Erosion nationaler Souveränität bzw. deren Krise, sondern erzeugen möglicherweise so etwas wie ein „Trostnarrativ“ im Hinblick auf das Gespenst des Versagens der Demokratie.

Le concept réfracté de la souveraineté et les États offshore

Si on reconnaît le souverain par sa faculté à trancher de façon décisive dans les situations historiques exceptionnelles, force est d’admettre aujourd’hui que ce souverain ne procède pas toujours selon les dispositions des États de droit. Sont également souverains, et rivalisent avec les « démocraties », quand ils n’en sont pas ses complices, les tenants d’une souveraineté offshore. La moitié du stock mondial d’argent transite par les paradis judiciaires et fiscaux, ports francs ou zones franches où financiers, avocats, gestionnaires brassent des sommes d’argent inouïes au carrefour de la gestion d’activités industrielles, financières, mafieuses et criminogènes. Là, la finance la moins imputable est en effet souveraine. Avec ses propres entités « offshore », dont certaines font partie de l’Union des 25 (le Luxembourg, Chypre et Malte), l’Europe incarne par moment ce problème majeur. Entre les États, les tricheurs, les criminels et le peuple, le concept de « souveraineté » se trouve hors foyer.

If we recognize the sovereign by its ability to emphatically decide in historically exceptional circumstances, then we must today admit that the sovereign doesn’t always take his decisions in accordance with the rule of law. The holders of offshore sovereignty are also sovereign and rival “democracies”, when they are not their accomplices. One half of global financial resources transit through fiscal or legal paradises, free ports or free zones where financiers, lawyers and managers move unheard of sums of money at the intersection of the management of industrial, financial, mafia and criminal activities. There, the least identifiable finance is in effect sovereign. With its own “offshore” entities, of which certain are a part of the Union of 25 (Luxemburg, Cyprus, and Malta), Europe incarnates this major problem. Between states, cheaters, criminals and the people, the concept of “sovereignty” finds itself displaced.

Wenn der Souverän an seiner Fähigkeit zu erkennen ist, in historischen Ausnahmesituationen über zentrale Fragen zu entscheiden, dann muss heute eingeräumt werden, dass dieser Souverän nicht immer gemäß rechtsstaatlichen Prinzipien verfährt. Die Statthalter einer „Offshore“-Souveränität sind gleichfalls souverän und rivalisieren mit den „Demokratien“, wenn die einen nicht sowieso Komplizen der anderen sind. Die Hälfte der globalen Geldströme wird über „Steuerparadiese“, Freihandelszonen und Freihäfen bewegt, wo Finanzjongleure, Rechtsanwälte und Vermögensverwalter am Kreuzungspunkt von industriellen und Finanzmarktaktivitäten einerseits sowie mafiösen und kriminellen Machenschaften andererseits unerhörte Geldmengen umwälzen. An diesen Plätzen ist dasjenige Kapital souverän, das sich der Besteuerung am effektivsten entziehen kann. Durch die Existenz von „Offshore“-Zonen, von denen einige sogar zur Europäischen Union gehören (Luxembourg, Zypern und Malta), innerhalb seiner eigenen Grenzen verkörpert Europa in gewisser Weise dieses gravierende Problem. Zwischen Staaten, Betrügern, Kriminellen und der Bevölkerung findet sich der Begriff der „Souveränität“ gleichsam ausgeschlossen.

L’origine de l’État et la nature de la coopération

Les grandes théories de l’origine de l’État ont toutes conclu qu’il existait un lien entre la démographie et l’organisation sociale chez l’humain. Comment rendre compte de cette relation sans s’exposer aux critiques classiques du fonctionnalisme en science sociale ? Dans cet article, nous soutenons que des contraintes cognitives limitent la formation de sociétés de grande taille. L’émergence de telles sociétés n’est possible que si les humains créent des institutions permettant une division sociale du travail de sanction, ce qui se traduit par une différenciation sociale accrue et par la centralisation du pouvoir politique.

The grand theories concerning the emergence of the state have all come to the conclusion of a strong interrelation between demographic factors and social organization. How can this relationship be taken into account without exposing oneself to the classical critiques of functionalism in the social sciences? The present article argues that cognitive constraints limit the possibility of building large social units. The emergence of large scale societies is only possible through the creation of institutions which allow for a division of labor in the field of sanctioning, which in turn fosters stronger social differentiation and centralization of power.

Die großen Theorien über die Entstehung des Staates kamen allesamt zu dem Schluss, es bestehe ein Zusammenhang zwischen demographischen Faktoren und der sozialen Organisation. Wie kann dieser Zusammenhang berücksichtigt werden, ohne sich den klassischen Kritiken am Funktionalismus in den Sozialwissenschaften auszusetzen? Im vorliegenden Artikel wird argumentiert, dass kognitive Beschränkungen der Bildung großer Sozialkörper Grenzen setzen. Die Entstehung solcher Gesellschaften ist nur möglich, wenn es zur Schaffung von Institutionen kommt, die eine soziale Arbeitsteilung im Bereich der Sanktionierung erlauben, was wiederum zu einer verstärkten sozialen Differenzierung und zur Zentralisierung politischer Macht führt.

Gouvernementalité et souveraineté. Quelques réflexions sur l’intégration européenne à partir de Michel Foucault

Une des caractéristiques les plus palpables de l’intégration européenne consiste certes en la délégation, au niveau européen, de certains pouvoirs et de certaines prérogatives « souveraines » des États membres. Dans ses écrits « généalogiques » sur l’évolution du système de rapports plus ou moins équilibrés entre les États européens, Michel Foucault soutient toutefois que ce concept de souveraineté ne permet pas de saisir correctement les mécanismes et enjeux qui, au bout du compte, déterminent cette évolution. Cet article prend la critique foucaldienne de la souveraineté comme point de départ pour ensuite introduire sa contre-proposition élaborée autour du concept de « gouvernementalité ». L’article se termine avec quelques réflexions sur la portée de ce concept en vue d’une meilleure compréhension de l’intégration européenne.

One of the most palpable characteristics of European integration consists certainly in the delegation of various national “sovereign” rights to the level of “communitarian” institutions. In his “genealogical” writings on the evolution of the more or less balanced relationship between European nations, Michel Foucault asserts however that the concept of sovereignty does not allow to an appropriate analysis of the mechanisms and key-issues which determine that process. The present article takes the Foucauldian critique of sovereignty as a starting point for the introduction of his counter-position connected with the term of “governmentality”. It ends with a discussion of the question of the extent to which this concept might help to better understand European integration.

Eines der auffallendsten Merkmale der europäischen Integration besteht zweifellos in der Delegation verschiedener „souveräner“ Hoheitsrechte der Mitgliedsstaaten der EU auf die Ebene europäischer Institutionen. In seinen historisch-„genealogischen“ Arbeiten über die Herausbildung des „europäischen Gleichgewichts“ vertritt Foucault jedoch entschieden die Auffassung, dass der Begriff der Souveränität nicht (mehr) geeignet sei, die Mechanismen, Strukturen und Motive, die diesen Prozess antreiben, angemessen zu analysieren. Der vorliegende Aufsatz entwickelt vor dem Hintergrund dieser Kritik Foucaults „gouvernementalistische“ Gegenposition und diskutiert abschließend einige Aspekte der Frage, inwieweit dieser Ansatz ein besseres Verständnis der europäischen Integration erlaubt.
