Résumé
Ce texte analyse les infractions liées à la grossesse au Code criminel canadien : avortement (disposition déclarée inconstitutionnelle), négligence à se procurer de l’aide lors de l’accouchement, infanticide, suppression de part et abandon d’enfant. S’appuyant notamment sur la jurisprudence récente relative à ces infractions, le texte questionne la cohérence et la modernité de ce régime législatif, qui semble être le reflet d’une époque révolue.

Abstract
This article analyzes pregnancy-related offences in the Canadian Criminal Code : abortion (which has been declared unconstitutional), neglect in childbirth, infanticide, concealing the body of a child, and abandoning a child. Relying on recent case-law that deals with these offences, the coherence and contemporaneity of the present legislative situation, which appears to be a reflection of a bygone era, is examined.

Este texto analiza las infracciones ligadas al embarazo en el Código Criminal canadiense : Aborto (disposición declarada inconstitucional), negligencia a procurarse ayuda en el parto, infanticidio, supresión de parte, y abandono del niño. Apoyándose, sobre todo, en la jurisprudencia reciente relativa a estas infracciones, el texto cuestiona la coherencia y la modernidad de este régimen legislativo, que parece ser el reflejo de otra época.
