Réflexions sur le processus de recodification du Code civil

Résumé

Cet article fait d'abord le point sur la situation de la réforme du Code civil au Québec. Il tente de montrer les phénomènes sociologiques sous-jacents qui sont à l'origine des difficultés et des retards qu'a connus le Québec dans cette entreprise depuis le dépôt du Projet de l'Office de révision du Code civil en 1978. Il examine enfin les conditions nécessaires au succès de l'opération de recodification qui en est à sa dernière étape.

Abstract

This article first examines the historical development of the Reform of the Civil Code of Quebec. It attempts to show how certain sociological factors have been at the origin of the difficulties and delays encountered by Quebec since the tabling of the Project of the Civil Code Revision Commission in 1978. Lastly it analyzes the necessary conditions that ought to be present for the success of this last episode of recodification.
